Terms of Service

1. Who we are

The service is operated under the name Risehai while its operating company completes registration in the United States. You can reach us at hello@risehai.com. These terms bind you and the operator of Risehai; if a registered entity succeeds that operator, your rights continue.

2. What the service is

Risehai is an AI artworker workspace for ad teams. The current product lets you organize creative files, keep durable agent sessions, request direct agent and image work, edit layered documents, review attributed document changes, and export an individual document. Features and provider availability can differ by deployment and plan.

3. Your account

Keep your credentials safe, give us accurate information, and notify us if you believe your account is compromised. You are responsible for activity under your account. We may suspend or close accounts that breach these terms or threaten the service.

4. Acceptable use

You agree not to:

• upload or process content you lack the right to use, or content that is unlawful, deceptive, or infringes another person's rights;
• use the service to create material that is illegal where you publish it;
• probe, overload, disrupt, bypass safeguards, or attempt to access another customer's data; or
• resell, sublicense, or white-label the service without our written agreement.

5. Your content

You retain ownership of what you upload and of service results created for you. You grant us a limited license to host, copy, transform, render, and transmit that content only as needed to provide and secure the service. You warrant that you have the rights needed for those uses. You remain responsible for reviewing content before publication.

6. AI and tool results

Requested agent and image work can use third-party AI providers as described in our Privacy Policy. Results may be incomplete or wrong. Tool receipts report what the service observed; they are not a promise that creative is fit for your intended market, legally compliant, or approved by your team.

7. Plans, credits, and payments

Paid model and image operations consume credits based on recorded usage. Subscriptions add the stated monthly credit grant, and unused credits remain on the account while it is open unless the checkout or plan terms say otherwise.

Subscriptions renew until cancelled. Cancellation takes effect at the end of the paid period. Upgrades may charge and grant credits immediately; downgrades ordinarily take effect at renewal. The product shows the applicable price and plan before purchase.

Paddle processes purchases as merchant of record, so its checkout terms apply and its name may appear on your statement. Refunds follow our Refund Policy.

8. Availability and changes

The service is a young beta. We do not offer an uptime guarantee or service credits. We may add, change, or remove features and providers, and will give reasonable notice when a material change affects paid use.

9. Disclaimers and liability

To the extent the law permits, the service is provided "as is" and "as available" without implied warranties. Our total aggregate liability arising from the service or these terms is limited to fees you paid us in the twelve months before the claim. Neither side is liable for indirect, incidental, or consequential damages. Nothing here limits liability that cannot legally be limited.

10. Ending the agreement

You may stop using the service and ask us to close your account. We may suspend or terminate access for a material breach, with notice where practicable. Content and records are handled under the retention and deletion section of our Privacy Policy; these terms do not promise a fixed export or deletion window the product does not enforce.

11. Changes to these terms

If we make a material change, we will notify you by email or in the product before it takes effect. Continued use after the effective date means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, and disputes belong to the courts located there. Consumers keep any mandatory protections of their country of residence.
